1. Acceptance of these terms

These Terms & Conditions ("Terms") govern your access to and use of the Crystal Heart Flow platform, website and any related services (together, the "Service").

By creating an account or using the Service, you agree to these Terms and to our Privacy Policy (set out in the Privacy tab of this Legal page). If you do not agree, you should not use the Service.

You must be at least 18 years old and have the legal capacity to enter into these Terms.

2. Changes to the Service and these Terms

We may update or change the Service, including features, plans and credit allowances, from time to time. We may also update these Terms as our Service evolves.

We will post the updated Terms here and update the 'Last updated' date. Where a change is significant, we will highlight it on the platform or notify active subscribers. Your continued use of the Service after a change takes effect means you accept the updated Terms.

3. Your account

You are responsible for keeping your account credentials secure and for all activity under your account. If you believe your account has been compromised, contact us promptly.

You must provide accurate information when registering and keep it up to date.

We may suspend or close an account that breaches these Terms, is used fraudulently, or causes risk or harm to the Service or others.

4. Subscriptions, credits and billing

Paid plans give you a monthly allowance of AI generation credits, and additional features as described on our Pricing page. You can also buy one-off credit top-ups.

Subscriptions are billed through Stripe and renew automatically until cancelled. You can manage or cancel your subscription at any time from your Profile or via the billing portal, and your plan continues until the end of the current billing period.

Credits are tied to your account. Monthly allowance credits reset on your reset date and do not roll over. One-off purchased credits do not expire and are used after your monthly allowance.

Unless required by law, payments are generally non-refundable. If you believe a charge is incorrect, contact us and we will review it.

We may change our pricing or credit allowances. Any change to an active paid subscription will take effect from the next renewal and we will notify you beforehand.

5. Acceptable use

You agree not to:

  • Use the Service to create, publish or store content that is unlawful, infringes others' rights, or is harmful, threatening, abusive, defamatory or misleading.
  • Attempt to access, reverse engineer or disrupt the Service, its systems or another user's account.
  • Use the Service to send spam or to violate the terms or policies of any social platform you connect.
  • Resell, sublicense or share your account or credits with others without our agreement.
  • Use the Service in a way that could damage, overload or impair the Service.

6. Your content and intellectual property

You retain ownership of the content you submit to the Service. By submitting content, you grant us a limited licence to use, process and store it solely as needed to provide the Service to you — including sending it to our AI provider to generate and repurpose your outputs.

AI-generated content is provided to assist you, and you are responsible for reviewing it before publishing. You should not publish content that relies on unverified claims, third-party intellectual property you don't have rights to, or anything that could mislead your audience.

We may use aggregated and anonymised data about how the Service is used to improve it, but we do not knowingly use your content to train AI models.

7. Connecting and publishing to social platforms

Where you connect a social platform (such as LinkedIn, Facebook Pages or Instagram Business) and publish through the Service, that connection and your published content are also governed by the platform's own terms and policies.

You are responsible for ensuring your use of each platform, and the content you post there, complies with that platform's rules and with applicable law. We are not responsible for actions a platform takes regarding your account or content, including suspensions or removals.

Platform availability, features and APIs may change at any time and are outside our control, which can affect auto-posting for a given platform.

8. Payments and third-party services

Payments are processed by Stripe under its own terms. Card details are handled entirely by Stripe and are not seen by us.

Our Service depends on third-party providers (including hosting, AI generation, analytics and the social platforms you connect). We are not responsible for the availability, accuracy or behaviour of those third parties beyond what is in our control.

9. Disclaimers

The Service is provided on an 'as is' and 'as available' basis. We do not guarantee that the Service will be uninterrupted, error-free, or that any generated content will be accurate, complete or suitable for your purposes.

AI-generated content may contain errors or unexpected results. You must review it before publishing and are solely responsible for what you publish.

Any statements about performance, growth or other outcomes are general examples and not guarantees of results for you.

10. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental or consequential losses arising from your use of the Service, including loss of revenue, profits, data or reputation.

Our total liability arising from or relating to these Terms or the Service is limited to the amount you have paid us in the 12 months before the event giving rise to the claim, or, where no payment has been made, to a nominal sum.

Nothing in these Terms excludes or limits liability that cannot be excluded by law, such as liability for death or personal injury caused by negligence or for fraud.

11. Indemnity

You agree to indemnify and hold us harmless from any claims, losses or damages arising from your content, your breach of these Terms, or your misuse of the Service or any connected social platform.

12. Suspension and termination

You can close your account at any time from your Profile. On termination, your right to use the Service ends and your content will be removed within a reasonable period, subject to legal retention duties.

To delete your account and associated data, use the self-service Delete Account option in your Profile, or see our public User Data Deletion page at crystalheartflow.com/DataDeletion. You can also contact us if you need assistance.

We may suspend or terminate access immediately where there is a serious or repeated breach of these Terms or where we need to protect the Service or others.

13. Governing law and disputes

These Terms are governed by the laws of England and Wales. Any dispute arising out of or in connection with them will be handled in the courts of England and Wales, except that you may bring a complaint in your local consumer protection authority if you are a consumer based outside the UK.
